The next meeting of the Working Group on “Improving the Civil Code of the Republic of Azerbaijan” was held

On October 30 of the current year, the next meeting of the Working Group on “Improving the Civil Code of the Republic of Azerbaijan” was held in a hybrid format at the Institute of Law and Human Rights. The meeting was attended by representatives of the Secretariat of the Commission on Business Environment and International Rankings of the Republic of Azerbaijan, The Center for Legal Examination and Legislative Initiatives, the Constitutional Court, the Supreme Court, the ministries of Economy, and Digital Development and Transport, the Central Bank, the Intellectual Property Agency, the Bar Association, Baku State University, the Academy of Public Administration under the President, and other members of the working group, including representatives of the private sector, as well as international expert, Professor Azer Aliyev of Martin Luther University Halle-Wittenberg in Germany. Representatives of interested parties (subjects applying the relevant norms or affected by their application) also participated in the meeting of the working group and expressed their opinions.

During the meeting, the draft Concept Document prepared for Chapter 2-1 (“Non-property Rights”), which is intended to be added to the Civil Code of the Republic of Azerbaijan, was discussed.

Opening the meeting with an introductory speech, Samir Mahmudov, Head of the Working Group and Executive Director of The Center for Legal Examination and Legislative Initiatives, gave a brief explanation of the general objectives, content, and structure of Chapter 2-1 (“Non-property Rights”) proposed to be added to the Civil Code, and also brought to attention information on local and foreign sources researched during the drafting of the provisions of that chapter. Stating that the preliminary draft of the relevant sections of the Concept Document on the chapter to be added to the Civil Code had been prepared for the current discussion, the Head of the Working Group noted that it is possible to submit additional proposals for the refinement of the document.

Subsequently, Vusal Shikhaliyev, Head of the Secretariat of the Commission, delivered a speech, noting that the working group is one of the largest groups under the Commission on Business Environment and International Rankings in terms of the number of members, and since its inception, it has been received with great acclaim by society, as well as experts and specialists working in the field of law. Speaking about the importance of improving the Civil Code, Vusal Shikhaliyev stated that during the work process, not only the opinions provided by state bodies are considered, but also the feedback from the private sector, NGOs, independent experts, and specialists, as well as international best practices.

In the course of the meeting, the provisions under the proposed Chapter 2-1 (“Non-property Rights”) were presented to the meeting participants, the proposals of the participants regarding the document were discussed, questions were answered, and it was stated that the document would be refined based on the feedback provided.

In conclusion, Samir Mahmudov informed the participants about the measures planned to be undertaken by the working group in the upcoming period.
