Meeting of the “Business Entry" Working Group was held

A meeting of the “Business Entry” Working Group of the Commission on Business Environment and International Rankings headed by the State Tax Service under the Ministry of Economy was held. The event was attended by members of the working group, responsible persons directly involved in its activities, and representatives of legal and consulting companies.

The head of the working group, the deputy head of the State Tax Service under the Ministry of Economy Samira Musayeva welcomed the meeting participants and brought to their attention the issues on the agenda.

Head of the Secretariat of Commission on Business Environment and International Rankings, Sector Head of the Department on Economic Policy and Industrial Affairs of the Administration of the President of the Republic of Azerbaijan Vusal Shikhaliyev informed about the methodology of the new "Business Ready" report of the World Bank Group and the upcoming priorities. The report evaluates the business environment in the world countries in the context of the development of the private sector, he mentioned. Azerbaijan is expected to be included in the report to be published in September 2025. Vusal Shikhaliyev expressed, that this project is based on components such as functionality of business areas in the country, business rules affecting the development of the private sector as a whole, and comparative evaluation of public services.

Samira Musayeva, Deputy Head of the State Tax Service made a presentation related to information on innovations in electronic state registration procedures of domestic and foreign-invested LLCs and the latest reforms in the field of business entry, as well as information on implemented activities, tasks ahead, within the "Road Map for the year 2024 on the implementation and communication of improvements in the relevant field related to the indicator of "Business Entry" of the "Business Ready” report  of the World Bank Group”. Stating that the practice of establishing a business has been improved taking into account the advanced international experience, S. Musayeva provided information on measures implemented towards increasing the transparency of digital state services for start-ups. She expressed, that according to the updated legislation, the electronic state registration procedures of local and foreign-invested LLCs have been aligned. This innovation has simplified the process of business entry by making the electronic registration service fully available for foreign entities in the country. Thus, during the e-state registration of foreign-invested LLCs, the data on the employment contracts concluded with employees for the first time will be transferred to the e-information system of the Ministry of Labour and Social Protection of Population, the requirement to attach a document confirming the legal address to the e-application will be removed, as well as the e-state registration will be possible not only for foreign natural persons, and foreign legal entities, as well. At the same time, it was submitted information that by checking documents of foreign origin issued with an electronic apostille through the appropriate program, activities are being implemented towards establishing a service of remote legalization and delivery of their translation by a notary via the information system.

S. Musayeva accented on measures within the framework of the Road Map for 2022-2023 implemented in the field of "Business Entry",  such as taking into account the persons who should be sanctioned in the registration process, and limiting the use of e-cabinet when the term of office of the head of a commercial legal entity ends. Moreover, it was created opportunities for electronic information change for LLCs with local investments. There provided grounds for refusal regarding the uniqueness of the name of a commercial legal entity. All this has led to a significant reduction in the stages of necessary regulations, procedures and time loss for those who want to start a business. S. Musayeva also informed the meeting participants on activities implemented towards authentication of foreign language documents and expansion of electronic services for legal entities with foreign investments.

During the meeting, a member of the working group, head of the Consular Affairs Department of the Consular Office of the Ministry of Foreign Affairs, Anar Mammadov provided information on activities implemented towards establishment of the "Consular Legalization" information system of the Ministry of Foreign Affairs and the organization of the service of remote legalization and delivery of the translation of legalized documents by a notary via the "Electronic Notary" information system.

Then, the deputy head of the State Tax Service, Samira Musayeva, made a presentation on the analysis of the level of preparation of the regulatory framework in the field of "business entry".

During the discussions, the members of the working group exchanged views on the upcoming tasks, including submitting of proposals, in order to improve the business environment in the country and achieve high results in international rankings.

Innovations in electronic state registration procedures of local and foreign-invested LLCs and reforms implemented in the field of business entry were discussed at the meeting. Representatives of various institutions, representatives of private companies, experts submitted their proposals regarding the issues.
